Privacy Policy Effective Date: 08/01/2019 Last Updated Date: 08/01/2019 This Privacy Policy is incorporated by reference into the Appliance Repair LA Terms of Service (the “Terms”). The term “Appliance Repair LA,” “we,” and “us” includes Appliance Repair LA, it’s parent company Sale Depot Inc., and our affiliates and subsidiaries. The Privacy Policy explains how Appliance Repair LA may: ● collect, ● use, and ● disclose information we obtain through the Service. All other terms not defined herein will have the meanings set forth in the Terms. Please read the following carefully to understand our views and practices regarding your personal data and how we will treat it. BY USING THE SERVICES YOU CONSENT TO THIS PRIVACY POLICY. “Personal Information” means information that alone or when in combination with other information may be used to readily identify, contact, or locate you, such as: name, mailing address, email address, phone number, birthday and any other personally identifiable information when you sign up for or use the Service. We do not consider Personal Information to include information that has been anonymized so that it does not allow a third party to easily identify a specific individual. If you choose not to provide the requested information, you may not be able to use some or all of the features of the Service. We may also collect other Personal Information from you when you access the Service and/or other parts of the Appliance Repair LA website (“Website”) and/or Appliance Repair LA mobile applications (“App(s)”) and elect to provide Personal Information. We also collect transaction details related to your use of the Service, including the service requested, date, time and location where the service was provided, amount charged, and other related transaction details. The Service facilitate communications between Technician and Appliance Repair LA Member. In connection with facilitating these communications, we may receive call or SMS message data, including the date and time of the call or SMS message, the parties’ phone numbers, and the content of the SMS message. We use this information solely for the purpose of facilitating such communications. Our App may collect certain additional information automatically, including, but not limited to, the type of mobile device you use, your mobile device’s unique device ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browsers you use, and information about the way you use the App. We may also use GPS technology (or other similar technology) to determine your current location. For example, if you permit the App to access location services through the permission system used by your mobile operating system, we may also collect the precise location of your device when the App is running in the foreground or background. We may also determine your approximate location from your IP address. THE SERVICE COLLECTS YOUR INFORMATION We collect Personal Information: ● if you are an Appliance Repair LA Member, when you book a service; ● if you are a Technician or Appliance Repair LA Member, when you register; ● when you use the Service; and ● when you communicate with us. Usage Data and Activity. We may collect and aggregate information or content about the use of our Website or Apps in a way that does not directly identify an individual user (“Usage Data”). Usage Data helps us understand trends in our users’ needs so that we can better consider new features or otherwise tailor or enhance our Services. This Privacy Policy in no way restricts or limits our collection and use of Usage Data, and we may share Usage Data about our users with our third party service providers for various purposes, including to help us better understand our customers’ needs and improve our Service. For example, each time you use the Website or Apps, we may automatically collect the type of Web browser you use, the pages you view, how you interact with links on the Services and the time and duration of your use of the Website or Apps. We may use such information and pool it with other information to track, for example, the total number of visitors to our Website or users of the Apps, the number of visitors to each page of our Website, number of App downloads, aggregated details related to use of the Services etc. Personal Information Collection. If you are an Appliance Repair LA Member, then you must provide Personal Information to Appliance Repair LA in order to book a service. To book a service, you will have to provide the service recipient’s first and last name, cell phone number, address, email address, gender, and birthday. If you are a Technician, you will have to complete the application process associated with the Technician Agreement, and provide Personal Information to Appliance Repair LA, including but not limited to, your name, email address, address, phone number. If you are an Appliance Repair LA Member and you register a personal account with us, then you will have to provide us with certain Personal Information when you create your account, such as your name, email address and phone number. Social Sign-On. We may enable you to sign-on using your social media credentials. If we do, we will collect Personal Information from the social media website when you use your social media credentials to log into the Service. For example, when you log in with your Facebook credentials, we may collect the Personal Information you have made publicly available in Facebook, such as your name and profile picture. Identify Verification. In order to verify your identity, you will need to provide information to our third- party service providers, such as a copy of your ID or the last four digits of your social security number. Making Payments. When you make payments through the Service, you may need to provide Personal Information to our third-party service providers, such as your credit card number or the credit card number of the person on whose behalf you are booking the service. Location Information from Your Mobile Device. We may collect and store your location information if you enable your mobile device to send it to us. Collection of this information may improve the provision of the Service. Customer Support. We may collect Personal Information through your communications with our customer-support team. Cookies, Automatic Data Collection, and Related Technologies. The Service collects and stores information that is generated automatically as you use it, including your preferences and anonymous usage statistics. When you visit the Service, we and our third-party service providers receive and record information on our server logs from your browser, including your IP address, and from cookies and similar technology. Cookies are small text files placed in visitors’ computer browsers to store their preferences. Most browsers allow you to block and delete cookies. However, if you do that, the Service may not work properly. By using the Service, you are authorizing us to gather, parse, and retain data related to the provision of the Service. HOW Appliance Repair LA USES YOUR INFORMATION We may use your Personal Information for the purpose for which it was provided, including without limitation for the purposes described further below: Provision and Monitoring of the Service. We will use your Personal Information to provide you with access to and to support your use of the Service, to administer your account, process payments and to better understand your use of the Service. For example, if you are a Appliance Repair LA Member, we may provide your Personal Information to a Technician to facilitate the Technician’s provision of Service to you and if you are a Technician, we may provide your Personal Information to a Appliance Repair LA Member to facilitate the Appliance Repair LA Member’s receipt of the Service. We also may send or facilitate communications between Appliance Repair LA Member and Technician. Internal and Service-Related Usage. We use information, including Personal Information, for internal and service-related purposes only and may provide it to third parties to allow us to facilitate the Service. We may use and retain any data we collect to provide and improve our services. Communications. We may send email to the email address you provide to us to verify your account and for informational and operational purposes, such as account management, customer service, or system maintenance. Marketing. We may use information, including Personal Information, to facilitate transmittal of information that may be useful, relevant, valuable or otherwise of interest to you. Aggregate Data. We may anonymize and aggregate data collected through the Service and use it for any purpose, including marketing purposes. Appliance Repair LA MAY DISCLOSE YOUR INFORMATION We may share your information: ● with our third-party service providers; ● to comply with legal obligations; ● to protect and defend our rights and property; and ● with your permission. We do not rent, sell, or share Personal Information about you with other people or nonaffiliated companies for their direct marketing purposes, unless we have your permission. We Use Vendors and Service Providers. We may share any information we receive with vendors and service providers retained in connection with the provision of the Service. For example, we may contract with service providers to provide certain services, such as hosting and maintenance, payment processing, data storage and management, marketing and promotions and customer research/analytics. Displaying to Other Users. If you are a Technician, then the Materials you post to the Service may be displayed on the Service. Appliance Repair LA Members may be able to see some information about you, such as your name and photo. We are not responsible for privacy practices of the other users who will view and use the posted information. Social Networking and Other Websites. The Service may allow you to share information, including Personal Information, with social networking websites, such as Facebook. We do not share your Personal Information with them unless you direct the Service to share it. Their use of the information will be governed by their privacy policies, and you may be able to modify your privacy settings on their websites. Search Engines. If you are a Technician, then Personal Information, such as your first name and last initial may also be accessible via search engines or similar services. Marketing. We do not rent, sell, or share Personal Information about you with other people or nonaffiliated companies for their direct marketing purposes, unless we have your permission. We may allow access to other data collected by the Service to enable the delivery of online advertising on this website, or otherwise facilitate transmittal of information that may be useful, relevant, valuable or otherwise of interest to you. As Required By Law and Similar Disclosures. We may access, preserve, and disclose your Personal Information, other account information, and content if we believe doing so is required or appropriate to: comply with law enforcement requests and legal process, such as a court order or subpoena; respond to your requests; protect yours’, ours’ or others’ rights, property, or safety; or otherwise enforce our rights under the Terms, or if you are a Technician, the Agreement Between Appliance Repair LA and Technician for use of Appliance Repair LA service on demand services. Merger, Sale, or Other Asset Transfers. If we are involved in a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, sale of company assets, or transition of service to another provider, then your information may be sold or transferred as part of such a transaction as permitted by law and/or contract. The use of your Personal Information following any of the foregoing events should be governed by the provisions of this Privacy Policy in effect at the time such Personal Information was collected. We may also disclose your Personal Information with your permission. SECURITY OF YOUR INFORMATION We take steps to ensure that your information is treated securely and in accordance with this Privacy Policy. Unfortunately, the Internet cannot be guaranteed to be 100% secure, and we cannot ensure or warrant the security of any information you provide to us. We do not accept liability for unintentional disclosure. By using the Service or providing Personal Information to us, you agree that we may communicate with you electronically regarding security, privacy, and administrative issues relating to your use of the Service. If we learn of a security system’s breach, we may attempt to notify you electronically by posting a notice on the Service or sending an e-mail to you. You may have a legal right to receive this notice in writing. LINKS Our Website and Apps may contain links or integrate with other websites and online services. Appliance Repair LA is not responsible or liable for any damage or loss related to your use of any third-party website or online service or for the privacy practices of such third parties. You should always read the terms and conditions and privacy policy of a third-party website or online service before using it, whether directly or in connection with your use of the Service. INTERNATIONAL USERS By using the Service, you will transfer data to the United States. By choosing to visit the Service or otherwise provide information to us, you agree that any dispute over privacy or the terms contained in this Privacy Policy will be governed by the law of the State of California and the adjudication of any disputes arising in connection with Appliance Repair LA or the Service will be in accordance with the Terms of Service. If you are visiting from the European Union or other regions with laws governing data collection and use, please note that you are agreeing to the transfer of your information to the United States and processing globally. By providing your information you consent to any transfer and processing in accordance with this Policy. UPDATE YOUR INFORMATION OR POSE A QUESTION OR SUGGESTION If you would like to update or correct any information that you have provided to us through your use of the Service or otherwise, or if you have suggestions for improving this Privacy Policy, please send an e- mail to clientcare@appliancerepairla.com. CHANGES TO OUR PRIVACY POLICY AND PRACTICES We may revise this Privacy Policy, so review it periodically. Posting of Revised Privacy Policy. We will post any adjustments to the Privacy Policy on this web page, and the revised version will be effective when it is posted. If you are concerned about how your information is used, bookmark this page and read this Privacy Policy periodically. New Uses of Personal Information. From time to time, we may desire to use Personal Information for uses not previously disclosed in our Privacy Policy. If our practices change regarding previously collected Personal Information in a way that would be materially less restrictive than stated in the version of this Privacy Policy in effect at the time we collected the information, we will make reasonable efforts to provide notice and obtain consent to any such uses as may be required by law. Contact Information clientcare@appliancerepairla.com STANDARDS & PRACTICES To maintain records of services performed; materials used and charges made for materials and services rendered. The customer will be given an itemized copy of the bill showing parts replaced and work performed for each repair. To maintain adequate test appliance(s) in helping with good servicing standards. To honor valid manufacturers' parts warranties on parts subject to replacement by local distributors. Costs incurred to obtain and handle said parts to be charged for and paid by the customer. To limit the replacement of parts to those required to restore the appliance(s) to normal operation. Should additional work be indicated the customer’s authorization will be obtained before proceeding. To keep charges fair and reasonable in accordance with good business practices and in accordance with the local servicing price schedule. a. A “service call” means a call to the home by a qualified Technician; service charges will be based on a maximum of ½ hour in the home; every effort will be made to restore appliance(s) to proper operation on the home call. If the appliance(s) cannot be repaired in the home the appliance(s) will not be moved from the home without the customer’s consent, either oral or written. At this time an approximate estimate of shop labor and handling charges can be given. An accurate estimate as to labor and materials needed cannot be given until a complete shop analysis and check is made. If the customer then does not want the appliance(s) repaired, the appliance(s) will then be returned with a shop diagnosis and handling charge to be paid by the customer. If the technician who responded to the call cannot repair the appliance(s) in the home and an approximate estimate is given and the customer does not want appliance(s) repaired, the firm is still entitled to be paid for sending the service technician to the home (the service call charge). b. On any in-home or shop repair, 1st-grade parts to be used as replacement either equal to or superior to the original parts and the old parts to be returned to the customer except in the case of parts that are subject to factory warranty replacement. THIS IS YOUR CLAIM RECEIPT AN ESTIMATE AS REQUIRED (SECTION 9844 OF THE CALIFORNIA BUSINESS AND PROFESSIONS CODE) FOR REPAIRS SHALL BE GIVEN TO THE CUSTOMER BY THE SERVICE DEALER IN WRITING, AND THE SERVICE DEALER MAY NOT CHARGE FOR WORK DONE OR PARTS SUPPLIED IN EXCESS OF THE ESTIMATE WITHOUT PRIOR CONSENT OF THE CUSTOMER. WHERE PROVIDED IN WRITING, THE SERVICE DEALER MAY CHARGE A REASONABLE FEE FOR SERVICES PROVIDED IN DETERMINING THE NATURE OF THE MALFUNCTION IN PREPARATION OF A WRITTEN ESTIMATE FOR REPAIR. FOR INFORMATION CONTACT THE BUREAU OF ELECTRONIC AND APPLIANCE REPAIR, DEPARTMENT OF CONSUMER AFFAIRS SACRAMENTO 95814. LABOR WARRANTY The labor warranty is 30 (thirty) days only. Labor warranties only apply to repair(s) and (or) service described on the reverse side. All warranty work honored from 9:00 AM to 4:00 PM Monday through Friday. No warranty work honored Saturdays, Sundays or Holidays. Labor charge(s) is (are) not refundable. After repairs are completed in the home or after delivery of the repaired appliance(s) from the shop, turn on the appliance(s) to see if it is operating to your satisfaction. If additional service is required after the technician has left the home and he must be “recalled” an additional charge based on the home time will be made. This is not a service call but a time charge that would have appeared on the original billing and the technician’s worked longer on the original call or shop repair; this recall price is granted for 5 days following the repair of the appliance(s). After 5 days any other service required is considered a new service call and you will be charged for the service call. PARTS WARRANTY Parts used in the repair of your appliance(s) are equal to or superior to the original parts in your appliance(s), these parts carry a normal 90-day warranty. If parts replaced fail during the warranty period, they will be replaced without charge for the parts. Customers will pay for labor and handling costs incurred to replace such parts. Only parts listed on this invoice are covered by this warranty. If other parts breakdown due to use or age or for any other reason beyond our control they will be replaced and the regular price for the material and labor rates will be charged. The clearing of clogged drains guaranteed ten (10) days only. There is no guarantee on the replacement of plastic or glass shelf supports or basket slides. METHOD OF PAYMENT All work will be paid for in cash upon the completion of the job unless credit arrangements have been made prior to the original service call or return of repaired appliance(s). LIMITED LIABILITY Our insurance carrier requires us to inform you that due to the nature of your appliance(s) removal, installation or reinstallation, any damage incurred by our service technicians to the product, the surrounding cabinets or the floor covering when removing your appliance for repair(s), any damage caused by water, oil or any other leakage before or after the repair and in performing the requested services, will be your responsibility, and thus will relieve us of any cost of repairs should damage occur (naturally, we will be as careful as possible). We will not be responsible for any loss of food or any other loss of any merchandise item before, after or at the time of the repair. CHECK POLICY There will be a $20.00 charge on all returned checks. All checks require a valid ID. The customer’s name has to be preprinted on the check. TERMS All orders require a 50% deposit. Balance upon completion, unless prior credit terms are established. Charge accounts balance unpaid after 30 days from the date of invoice are subject to a late payment charge of 1 ½% per month or the maximum allowed by law, if different. Expenses incidental to the collection, including reasonable attorney’s fees, are the responsibility of the purchaser. THE WARRANTY WILL BE TERMINATED IF THE APPLIANCE(S) ARE REMOVED FROM THE PREMISES. INTERMITTENT CONDITION WARRANTY There is absolutely no labor warranty on any parts with an intermittent problem. Since the problem is not apparent it cannot be traced. The only time such a problem can be traced is when the problem actually exists.
